Wolin & Rosen Defends Company Against Indemnification Claim By Former Employee Seeking $1.5M in Defense Costs
Wolin & Rosen successfully defended a Limited Liability Company in United States District Court against claims brought by a former employee. Plaintiff alleged that the business owed its former employee reimbursement of approximately $1.5M expended in defense of a lawsuit for activities the former employee asserted were within the scope of employment. Jeffrey Schulman of Wolin & Rosen argued the company’s motion to dismiss. The Court held that the activities of the former employee were not within the scope of employment and that the company owed no duty to indemnify.
